Ordinance No. 22 of 2026

AN ORDINANCE AMENDING CHAPTER 169 OF THE CODE OF THE CITY OF SOMERS POINT, COUNTY OF ATLANTIC, STATE OF NEW JERSEY, TO UPDATE THE ADOPTED PROPERTY MAINTENANCE CODE

WHEREAS, the City of Somers Point has previously adopted the International Property Maintenance Code, 2000 Edition as set forth in § 169-20 of the City Code; and

WHEREAS, the City desires to update its Property Maintenance Code to reflect current standards and best practices for the maintenance of buildings and structures; and

WHEREAS, the International Property Maintenance Code, 2021 Edition provides updated regulations, provisions, penalties, and conditions for property maintenance;

NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of Somers Point, County of Atlantic, State of New Jersey, as follows:

SECTION 1. § 169-20 of the Code of the City of Somers Point, entitled “Adoption of standards; copies on file,” is hereby amended to read as follows:

§ 169-20 Adoption of standards; copies on file.

A certain document, three copies of which are on file in the office of the City Clerk of the City of Somers Point, pursuant to N.J.S.A. 40:49-5.1 et seq., being marked and designated as the "International Property Maintenance Code, 2021 Edition," be and is hereby adopted as the Property Maintenance Code of the City of Somers Point, County of Atlantic and State of New Jersey, for the control of buildings and structures as herein provided, and each of the regulations, provisions, penalties, and conditions of said Code are hereby adopted and made a part hereof as if fully set forth in this article.

SECTION 2. REPEALER.

All ordinances or parts of ordinances inconsistent herewith are hereby repealed to the extent of such inconsistency, including the prior adoption of the International Property Maintenance Code, 2000 Edition.

SECTION 3. SEVERABILITY.

If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be unconstitutional or invalid by a court of competent jurisdiction, such decision shall not affect the remaining portions of this Ordinance.

Notice is hereby given that the foregoing ordinance was introduced and passed first reading at a regular City Council meeting of August 27, 2026 and said ordinance will be further considered for final passage and adoption after a public hearing to be held on September 10, 2026 at 7:00 p.m. in City Council Chambers, 1 West New Jersey Avenue, Somers Point, NJ 08244.
