Ordinance No. 18 of 2026


AN ORDINANCE AMENDING CHAPTER 114, “LAND USE AND DEVELOPMENT,”

ARTICLE XVI, “SOMERS POINT HISTORIC DISTRICT,” SECTION 114-101,

“HISTORIC VILLAGE WATERFRONT ZONE,” TO REMOVE THE

REQUIREMENT FOR A LANDSCAPED HARBORWALK


WHEREAS, the City of Somers Point has adopted a Master Plan and Land Use Ordinance to guide the orderly development and redevelopment of property within the City; and

WHEREAS, the City has recently undertaken a review of its Master Plan, including policies related to waterfront access and development; and

WHEREAS, as a result of that review, the requirement for a mandatory landscaped harborwalk within the Historic Village Waterfront Zone is no longer deemed necessary nor appropriate; and

WHEREAS, the City Council finds that it is in the best interest of the City to amend the Land Use Ordinance to remove said requirement and ensure consistency with the Master Plan;

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Somers Point, County of Atlantic, State of New Jersey, as follows:

SECTION 1.

Chapter 114, Land Use and Development, Article XVI, Somers Point Historic District,” Section 114-101, Historic Village Waterfront Zone,” Paragraph (E), “Relationship of structure to Great Egg Harbor Bay,” Subparagraph (1), is hereby deleted in its entirety and replaced with the following language:

All uses located on property abutting the Great Egg Harbor Bay shall provide, in a manner acceptable to the municipal agency, reasonable public access to the harbor as may be required by the New Jersey Department of Environmental Protection. Buildings shall be set back a minimum of 25 feet from the water as measured from he mean high-water line.

SECTION 2. SEVERABILITY

If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by a court of competent jurisdiction, such decision shall not affect the remaining portions of this Ordinance.

SECTION 3. REPEALER

All ordinances or parts of ordinances inconsistent herewith are hereby repealed to the extent of such inconsistency.

SECTION 4. EFFECTIVE DATE

This Ordinance shall take effect upon final passage and publication in accordance with law.


Notice is hereby given that the foregoing ordinance was introduced and passed first reading at a regular City Council meeting of 6/25/2026 and said ordinance will be further considered for final passage and adoption after a public hearing to be held on 7/9/2026 at 7:00 p.m. in City Council Chambers, 1 West New Jersey Avenue, Somers Point, NJ 08244.
